Mosley v. Google

Am 30. März 2008 berichtete die britische Boulevardzeitung News of the World unter der Überschrift „F1 Boss has Sick Nazi Orgy with Five Hookers“ über ein mehrstündiges Video, das den damaligen FIA-Präsidenten Max Mosley bei sadomasochistischen Praktiken zeigt. Dieser wehrte sich gegen die nachfolgende Medienlawine mit juristischen Mitteln, unter anderem mit Klagen gegen die britische News Group und den deutschen Springer-Verlag, bis hinauf zum Europäischen Gerichtshof für Menschenrechte.

Nachdem im Sommer 2011 noch bekannt wurde, dass „News of the World“ in einen Abhörskandal verwickelt war, ordnete der britische Premierminister Cameron eine Untersuchungskommision an, die Leveson Inquiry, benannt nach ihrem Vorsitzenden. Diese Kommission führt Beweisaufnahmen durch und hört Zeugen an. Gestern trat Mosley mit einer umfangreichen Stellungnahme auf und berichtete auch über seine rechtlichen Schritte gegen Google:

LORD JUSTICE LEVESON: How many sites have you been able to close down?  If you don’t know exactly — I’m just trying to get a feel for the size of the exercise.

MAX MOSLEY: It’s in the hundreds.  My lawyers would probably produce an exact figure.  One of the difficulties is that Google have these automatic search machines so if somebody puts something up somewhere, if you Google my name, it will appear.  We’ve been saying to Google, you shouldn’t do this, this material is illegal, these pictures have been ruled illegal in the English High Court.  They say we’re not obliged to police the web and we don’t want to police the web, so we have brought proceedings against them in France and Germany where the jurisprudence is favourable.  We’re also considering bringing proceedings against them in California.
